Buenos Aires, March 23 (NA) -- The lawyer for the detained tourist, Agostina Páez, Carla Junqueira, estimated this Monday that her client should receive a 'low sentence, with the possibility of returning to Argentina,' as this would be 'the most fair' in the trial that begins this Tuesday in Brazil against the influencer and lawyer for 'racial insult.' 'In any case, I am going to recommend to Agostina that she not answer anything,' clarified the lawyer, while adding: 'If everything extends beyond 48 hours, I will request that the precautionary measure be revoked and that she return to Argentina to continue with the proceedings via videoconference.' The lawyer reiterated that 'the objective is to achieve a sentence that is eligible for release' and detailed the state of mind Páez is facing these hours: 'She is under psychological and psychiatric care, taking anxiety medication, because she is very nervous, very anxious.' Regarding the letter of repentance that the influencer wrote and the video in which she apologized, Junqueira estimated that they should be 'taken into account' at the time of the verdict. 'This judge, despite being very strict in the precautionary phase, will leave the technical part for the sentence, and I am sure that he will take these mitigating factors into consideration,' she specified. The lawyer denied that the crime of racial insult in Brazil is applied only to Argentines or other foreigners, since in that country 'of the 297 prisoners currently serving sentences in prison for racism, the vast majority are Brazilians.' The lawyer maintained that 'few Argentines or foreigners end up in prison in Brazil for this' and pointed out that 'they generally return to their countries.' 'In fact, Brazilians understand that Agostina was privileged by being able to be under house arrest, but they forget that she could not return to Argentina,' indicated Junqueira, who also represented actress Thelma Fardin in the case against Juan Darthés. She explained: 'We have reported all the threats and harassment she suffered and we understand that from now on there are no more reasons for her to continue staying in Brazil in case the trial is extended,' she specified. 'That would be the most fair,' Junqueira explained in statements to the 'Tiempo de policiales' program, which is broadcast on ATP Stream. In this way, the lawyer was optimistic about the sentence she could receive, beyond the fact that the prosecution requested 15 years in prison for Páez, who is 29 years old and has been detained since mid-January. Sources in the case informed the Argentine News Agency that the accuser side, the prosecutor's office, and the private prosecution will present their conclusions at the first hearing in Criminal Court No. 37, presided over by Judge Guilherme Schilling Pollo Duarte. Regarding a sentence that includes a ban on returning to Brazil, the lawyer explained: 'That does not necessarily have to happen. It is not something that the Prosecutor's Office or the private prosecution have requested.' Junqueira stated that the sentence could be known this Tuesday, Wednesday, or it may take longer, as 'it will depend on the statements of the private prosecution, the questions from the prosecutor's office, and other details.' 'All those mitigating factors must be taken into account when it comes to the sentence and the definition of the penalty.' 'I don't want to create expectations because one doesn't know what goes through a judge's mind in a trial. It could arise, yes, but it was not requested.'
